General Terms and Conditions of Hire

  1. Hire Charges. All quoted services and prices are subject to availability, do not constitute an offer, and may be revised or withdrawn prior to our express acceptance of your order. No order will be accepted without your prior receipt of a written quotation. Your order constitutes an offer to purchase services under the specific terms stated in a quotation. On our acceptance of your order, you are liable to pay any fees including the *deposit (see below) due according to the terms stated in the quotation. Late payment may delay or prevent delivery, and may give rise to administrative or other charges.

  2. Hire Periods. All equipment must be returned or made available for collection at or before the time agreed. For each day or part day it remains outstanding a hirer may otherwise be charged the greater of the daily hire rate for each outstanding item, or the sum of direct and consequential losses attributable to its late return.

  3. The Hirer is liable to pay a cancellation fee of 25% of the hire charge to the Owner upon cancellation within 24 hours of the event start time.

  4. The Hirer cannot cancel the contract once the Equipment has been delivered, unless we agree to such cancellation.

  5. Delivery and Setup

  6. In the unprecedented event that we cannot fulfil an engagement, our liability is limited to the cost of arranging alternative hire, subject to a maximum of the fee we have agreed with you. We cannot accept liability for any other direct or consequential losses. Our liability is also limited by giving you notice, in the same proportion and applying the same periods we apply to your liability to us (see above), and by force majeure.

  7. Force majeure. We will not be liable for any failure to supply a product or service where that failure is wholly caused by an event beyond our control that we could not reasonably anticipate, forestall or prevent. This may include (but is not limited to) acts of war, terrorism, extreme weather conditions, or natural disasters. Where any public authority advises that only essential journeys should be undertaken, any product or service we supply shall not be considered essential.

  8. Ownership. All hired equipment remains the property of Cart Shed Karaoke. You may not sell, lease, lend, sub-hire, modify or dispose of hired equipment. Where hire forms part of a purchase agreement, equipment remains the property of Cart Shed Karaoke.

  9. Specified Equipment. We are constantly seeking to improve the systems and equipment available. The equipment provided may therefore not be exactly as specified (although it will be equivalent to or better than the equipment specified). If it is essential to you that a particular item is exactly as specified, please confirm this with us before you place an order.

  10. Condition of Equipment. Where equipment is used without our supervision, we check the condition and operation of all items before they leave us. On accepting delivery you agree that an item is in good condition and fully operational.

  11. Use of Equipment. It is your responsibility to ensure hired equipment is suitable for the purpose, and is used safely and legally. Anyone appointed to operate or supervise equipment must be competent to do so (and must have received any appropriate training where required by circumstance or law). Equipment may only be used within manufacturer guidelines (manuals are available on request). Loudspeaker controllers are supplied correctly configured, and may not be adjusted or bypassed. Any misuse of hired equipment entitles Cart Shed Karaoke to its immediate recovery without notice or penalty, and may result in further action if it has been tampered with or damaged. *See Responsibilities and Penalties for further info.

  12. Service and Repair. No service, repair, or non-user adjustment (as determined by the manufacturer) may be attempted without the prior express consent ofCart Shed Karaoke. Where user-replaceable parts (e.g. fuses or lamps) are fitted by a hirer, only manufacturer-specified replacements may be used. Removal of covers or cover screws in all cases invalidates the manufacturer's warranty, and you are liable for the full cost of replacing equipment where evidence of such tampering is found.

  13. Lost or Damaged Equipment. We cannot accept responsibility for crowd control or for the safety or security of any other party's premises, and unless it arises through our own actions you are liable to us for the whole cost of any damage to or theft or loss of our equipment at the event site however it is caused, *see Charges for further info.

  14. Equipment Failure. All equipment we supply is electrically safe, fully operational, and in good condition. All our equipment is also of professional standard and well-maintained. Catastrophic equipment failure is therefore unusual and unlikely (and in our own equipment, unprecedented). However, we cannot accept liability for any direct or consequential losses arising from equipment failure.

  15. Electricity Supply. It is your responsibility to ensure provision of a safe 230 volt AC power supply, provided from standard 13-amp sockets (or, by prior arrangement, 16-amp, 32-amp or 63-amp single-phase 230V Ceeform sockets). Where portable generators are used, these must be regulated and adequately grounded. WE DO NOT OTHERWISE CONSENT TO USE OF OUR EQUIPMENT.

  16. Third-Party Equipment. It is your responsibility to ensure that any other electrical equipment used in combination with ours is functionally and electrically safe. WE DO NOT OTHERWISE CONSENT TO USE OF OUR EQUIPMENT. Where inspection or test records are not available, the presumption will be that equipment is unsafe.

  17. Loudspeaker Volume. Our loudspeaker systems are capable of producing very high sound pressure levels. High volume may be necessary to match on-stage instruments, or to project adequate levels to distant points in a large arena. Anyone using or operating our equipment may set levels that exceed HSE guidelines (either locally, or throughout the arena). The risk of feedback - also a cause of high sound pressure levels - is inherent in monitor systems. HIGH SOUND PRESSURE LEVELS CAN CAUSE PERMANENT HEARING DAMAGE. Repeated exposure can have a cumulative effect. It is your responsibility to ensure that anyone who may be affected takes any necessary steps to protect their own hearing (whether by limiting exposure time, staying at a greater distance from loudspeakers, using ear-plugs or defenders, or employing some combination of these or other appropriate measures). You may therefore wish to ensure that warning notices are displayed, hearing protection is issued, or safety barriers are erected. You expressly agree to indemnify Cart Shed Karaoke for all costs and claims arising from loudspeaker output levels.

  18. Exclusivity and Variation. Other terms and conditions may apply to any agreement you have with us (whether or not they form part of any written statement), and the above terms do not apply exclusively. Any variation must be specifically agreed by Cart Shed Karaoke in writing. These terms take priority over any agreement where no other written statement exists.

 

*Deposit

A deposit of £150 may be taken on the day if not before in case of negligence. Reasonable wear and tear expected but please read Terms and Conditions, specifically *Charges for further details on negligence. 

 

The deposit of £150 will be fully refunded on the day of collection or a day after collection. Depending on your bank the deposit may take longer to be released. The deposit and hire service fee is to be paid in full before the hire date or upon completion of the set up. The hire service fee can be paid via card or cash but deposits can only be taken by card. Payments can be made using a secure card reader, mobile banking and over the phone.

*Charges

The Hirer will pay the full or the outstanding amount before the hire date or upon completion of the setup. 

The Owner reserves the right to impose additional charges on the Hirer in connection with cleaning or repairing Equipment not returned in clean and good working condition. The equipment shall be at the risk of the hirer as to all loss and damage whatsoever during the hire period and the hirer will be responsible for paying the first £1000 towards the costs of replacement or repair to any individual piece of equipment, which is damaged, lost or stolen whilst in the hirer’s care except where this is due to negligence on the part of the hirer in which case the hirer will be responsible for meeting the full cost of replacement or repair to the equipment.

 

*Penalties

(Any equipment returned after the booked return date will be charged for at a minimum of one extra day hire fee, regardless of the original hire period.) The Owner is authorised by this contract to contact the hirer at the hirer’s premises at any time in the recovery of equipment not returned at the end of the hire period.

Cart Shed Karaoke will check the equipment and inform the hirer within 7 working days of any loss or damage. Any costs incurred to the Owner in respect of replacement or repair, or if equipment is lost or damaged during the hire period must be met by the Hirer.

*Responsibilities

Equipment is to be kept in a secure safe, dry environment, under shelter with no exposure to rain and other elements such as food, drink or other liquids. Should the Hirer not adhere to this then the Owner reserves the right to charge the hirer for any damage

 

The Hirer shall use the equipment in a skilful and proper manner and shall at its own expense keep the Equipment in good and substantial repair and condition, reasonable wear and tear expected. To keep the same insured against fire, loss, damage or risk from whatever cause arising in the full replacement value thereof including a year’s loss of hire in some insurance office or offices of repute and will permit the Owner at all reasonable times to have access to the equipment and to inspect the state and condition thereof.

 

The hirer undertakes to keep and return equipment in good order and the same condition as provided at the point of hire. Any equipment returned in a badly soiled or dirty condition may incur a cleaning charge.

 

Connectors must not be removed from equipment. The Owner reserves the right to charge for refitting or inspecting any connectors found to have been removed, or tampered with. Equipment must not be modified in any way. Failure to return any cable(s) may result in a charge for replacing the said cable(s). Packaging/Casing supplied with equipment must be returned, or it will be charged for.

 

The Hirer will be held liable for the full loss of any equipment confiscated because of a failure to comply with any relevant laws and regulations.

 

Termination of Hire

If the Hirer shall make default in punctual payment of the sums to be paid by it for the hire of the equipment or shall fail to observe or perform the terms and conditions of this agreement on its part to be observed and performed or if the Hirer shall do or cause to be done or permit or suffer any act or thing whereby the Owner’s rights in the equipment may be prejudiced or put in jeopardy, this agreement shall forthwith determine (without any notice or other act on the part of the owner and notwithstanding that the same may be waived some previous default or matter of a same or like nature) and it shall thereupon be lawful for the Owner to re-take possession of the equipment and for that purpose enter into or upon any premises where the same may be and the determination of the hiring under this clause shall not affect the right of the Owner to recover from the Hirer any monies due to the Owner under this agreement or damages for breach thereof.

Any waiver or other indulgence granted by the Owner shall not affect the strict rights of the Owner under their terms.
